GENERAL GUIDELINES ON THE PROCESSING OF PERSONAL DATA IN ELETROBRAS

We recognize the importance of the privacy and security of the personal data of our customers, employees, suppliers, service providers and other partners, obtained as a result of the business relationship. To express our respect for the principle of protecting privacy and the Data Protection Law, we have established the Policy of Protection of Personal Data & Privacy of Eletrobras Companies.

Our policy aims to establish guidelines for the processing of personal data, protecting the privacy of stakeholders, aiming at the management of personal data and the management of privacy incidents in the conventional or technology environment of our companies.

One of the most important aspects of our policy is the commitment that processes involving the collection of personal data must be adjusted by Eletrobras companies based on the concept of minimum collection, with specific purposes and the respective consent, when applicable.

In addition to this Policy, there are also internal regulations with guidelines on the Processing of personal data, Rights of Data Subjects and Governance of Risks to the Holder of Personal Data. In this way, it is possible to formalize the activities of the privacy governance process, its players, its roles and respective responsibilities, in addition to providing guidance on the registration of data processing and Data Protection Impact Assessment.

Our employees are aware of this policy and violation of the rules may result in disciplinary action. Only qualified and authorized personnel are permitted to access collected personal data.

REQUEST OF RIGHTS BY THE DATA SUBJECT

The holder of personal data has the right to request from the controller, at any time:

Confirmation of the existence of processing (Art. 18, item I of the LGPD)

Access to personal data processed by the Controller. (Art. 18, item II of the LGPD). 

Correction of incomplete, inaccurate or outdated data (Art. 18, item III of the LGPD)

Anonymization, blocking or deletion of data (Art. 18, item IV of the LGPD) 

Deletion of personal data processed with consent (Art. 18, item VI of the LGPD)

Information from public and private entities with which the controller shared data (Art. 18, item VII of the LGPD)

Revocation of consent (Art. 18, item IX of the LGPD)

Opposition to data processing (Art. 20 of the LGPD)

We will respond to your requests within 15 (fifteen) calendar days, from the date of your request.

Any and all requests regarding your personal data are free of charge.

PERSONAL DATA PROCESSED 

The personal data processed by ELETROBRAS will be those strictly necessary to fulfill the specific purpose proposed. If at any time it is necessary to process any sensitive personal data, we will employ even stricter security mechanisms and measures to guarantee the security of this information. 

 Below, we declare our position regarding some types of personal data processing.

Collection of personal data

Through our service channels, gathered on our page called “Fale Conosco” (Contact Us) it is possible that your personal data such as name, telephone and email will be requested so that you can receive the expected response with clarification regarding your requests made. Furthermore, when accessing some of the functionalities available on this website, some personal data may be collected, necessary for the correct functioning of the page.

We are responsible for the security of personal data collected on our website. If it is necessary to redirect your access to websites belonging to other organizations or companies, the responsibility for any personal data collected is the responsibility of these other organizations.  

In addition to the data mentioned in the paragraph above, Eletrobras processes personal data of employees, interns, contractors and other collaborators. Such processing has records with specific information about the purpose of processing.

Eletrobras does not operate in the energy distribution sector and, therefore, does not process personal data of energy consumers.

Sharing of personal data

We guarantee, as a general rule, that only Eletrobras has access to your collected personal data, and that it will not be shared with third parties, except by law or request by competent authority, or to respond to questions or investigations by control bodies.

Eletrobras may share personal data with its controlled companies and suppliers, as long as necessary to meet requests made by the holder of personal data or any legal or contractual requirement. In some circumstances, Eletrobras may be legally obliged to share personal data to respond to inquiries or investigations.

For this sharing, rights and duties of the parties are established, aiming to prevent the use of personal data in a manner different from that established by the company and/or in violation of applicable privacy legislation, only for a determined period, even after the end of the relationship between the parties.

Personal data retention/storage time

We inform you that your personal data is kept only for the necessary period, according to the purpose that justified certain processing. 

The criteria used to determine the period for which data will be kept are, mainly, but not exclusively:

• Until the specific purpose of processing personal data is achieved;

• As long as the demand or the statute of limitations provided by law continues, in defense of your rights or the rights of Eletrobras;

• Until the requests, complaints or suggestions presented are met.

During the period in which personal data remains under the control of Eletrobras, we are committed to adopting conservation and security measures. 

Eletrobras employs technical and organizational measures to protect the integrity, confidentiality and availability of your personal data processed, in accordance with the company's Information Security guidelines, always seeking to prevent improper access and use from occurring.

UPDATES AND REVISIONS TO THE PRIVACY STATEMENT

To always protect your privacy, ELETROBRAS reserves the right to review and change this Declaration at any time, so we ask that you consult this document periodically.  

The changes will take effect from the date of the last update.
